These Terms of Service (“Terms”) govern the relationship between Bob Behrends Roofing and Gutters, LLC (“Company,” “we,” “us,” or “our”) and any individual or entity (“Client,” “you,” or “your”) who requests, receives, or contracts for roofing inspection, repair, installation, replacement, or related services (“Services”). By requesting an estimate, signing a proposal, or engaging us for Services, you agree to these Terms.
1. Scope of Services
Services provided by the Company will be described in a written estimate, proposal, or contract (“Project Agreement”) provided to the Client prior to the commencement of work. Any work not explicitly included in the Project Agreement is considered outside the scope of the original agreement and may require a change order and additional cost.
2. Estimates and Pricing
- Estimates are based on a visual inspection and/or information available at the time of assessment and are subject to change if concealed conditions (e.g., rotted decking, structural damage, code violations) are discovered once work begins.
- Prices are valid for [30] days from the date of the estimate unless otherwise stated.
- Any changes to the scope of work requested by the Client after acceptance of the Project Agreement will be documented in a written change order and may affect the price and timeline.
3. Payment Terms
- A deposit may be required prior to the start of work, with the balance due upon completion, unless otherwise specified in the Project Agreement.
- Accepted payment methods will be listed on the invoice.
- Late payments may be subject to a finance charge of [__]% per month or the maximum allowed by law.
- The Company reserves the right to place a mechanic’s lien on the property for unpaid balances, in accordance with applicable state law.
4. Permits and Code Compliance
The Company will obtain necessary building permits for jobs that require them, unless otherwise agreed in writing. The Client is responsible for providing accurate property information and for any homeowners’ association (HOA) approvals required prior to work beginning.
5. Scheduling and Weather Delays
Scheduled start and completion dates are estimates only. Roofing work is weather-dependent, and the Company is not liable for delays caused by weather, material shortages, permitting delays, or other circumstances beyond its reasonable control.
6. Materials and Workmanship Warranty
- The Company warrants its workmanship for a period of 5 years from the date of completion, covering defects in installation under normal use and conditions.
- Manufacturer warranties on materials (shingles, underlayment, flashing, etc.) are provided separately by the manufacturer and are subject to their own terms; the Company will provide documentation of applicable manufacturer warranties upon request.
- This warranty does not cover damage resulting from: acts of nature (hail, wind events exceeding rated tolerances, etc.), lack of maintenance, unauthorized repairs by third parties, or normal wear and tear.
7. Client Responsibilities
The Client agrees to:
- Provide reasonable access to the property, including driveway and yard access for equipment and material delivery/dumpster placement.
- Remove or secure fragile items inside the home (e.g., wall décor, items in the attic) prior to the start of work, as vibration during roofing work may occur.
- Arrange for pets to be secured during working hours.
- Notify the Company of any known hazardous conditions on the property (e.g., asbestos, unstable structures).
8. Property Access and Site Conditions
The Company will take reasonable precautions to protect landscaping, gutters, siding, and other property features during the course of work. However, some incidental impact (e.g., minor landscaping disturbance, nail debris) is a normal part of roofing work. The Company will conduct a magnetic nail sweep and general debris cleanup upon completion.
9. Insurance
The Company carries general liability insurance and workers’ compensation insurance as required by law. Proof of insurance is available upon request. Clients working with insurance claims are responsible for their own communications with their insurance carrier; the Company can provide documentation and estimates to support a claim but does not guarantee claim approval or coverage amounts.
10. Limitation of Liability
To the extent permitted by law, the Company’s liability for any claim arising from the Services is limited to the amount paid by the Client for the Services giving rise to the claim. The Company is not liable for indirect, incidental, or consequential damages.
11. Cancellation Policy
- Clients may cancel a signed Project Agreement within [3] business days of signing without penalty, in accordance with applicable consumer protection laws.
- Cancellations after this period, or after materials have been ordered or work has begun, may be subject to a cancellation fee to cover costs already incurred.
12. Dispute Resolution
Any disputes arising from these Terms or the Services provided shall first be addressed through good-faith negotiation between the parties. If unresolved, disputes may be subject to mediation or arbitration in [County, State], and any legal proceedings shall be governed by the laws of the State of [State].
13. Photographs and Marketing
The Company may take before-and-after photographs of completed work for quality assurance and marketing purposes. Photos will not include identifying information about the Client (such as address or name) without separate written consent, unless otherwise agreed.
14. Changes to These Terms
The Company reserves the right to update these Terms at any time. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
